Mobile Terms of Use
The By You mobile messaging service (the "Service") is operated by By You ("By You," "we," or "us"). By using the Service, you agree to these terms of service ("Mobile Terms"). We may modify or discontinue the Service or its features at any time without notice. To the extent permitted by law, we may modify these Mobile Terms at any time. Your continued use of the Service after such changes become effective constitutes your acceptance of those changes.
By using the By You text messaging service, you agree to receive periodic text messages from and on behalf of By You through your wireless service provider to the wireless number you provide, even if your wireless number is on a state or federal block list. Text messages may be sent using an automatic telephone dialing system or other technology. Advertising messages may include promotions, special offers, and other marketing offers (e.g., shopping cart reminders).
You understand that you are not required to enroll in this Program to make purchases from By You, and that your consent is not a condition of making a purchase from By You. Your participation in this Program is entirely voluntary.
We do not charge for the service, but you will be responsible for any text messaging charges charged by your wireless service provider. Message frequency varies. Message and data rates may apply. Check your wireless service plan and contact your wireless service provider for details. You are solely responsible for all costs associated with text messaging, including your wireless service provider's fees.
You can unsubscribe from the service at any time. To do so, send the keyword "STOP" via text message to ByYou or click the unsubscribe link (if available) in any text message. You will receive a one-time confirmation text message. No further messages will be sent to your mobile device unless you request them. If you have subscribed to other ByYou mobile messaging programs and wish to unsubscribe, you must unsubscribe from those programs separately by following the instructions in the applicable mobile messaging terms and conditions, unless otherwise required by law.

We may change the short codes and phone numbers used for the Service at any time and will notify you of such changes. You acknowledge that messages, including STOP or HELP requests, sent to a short code or phone number we have changed may not be received. We are not responsible for processing such requests.
The mobile operators supported by the service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile phone number. If you receive a new mobile phone number, you must enroll in the program using your new number.
To the extent permitted by applicable law, you agree that we are not liable for any failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any actions you take or fail to take in reliance on the information or the Service.
